We provide this Privacy Policy to explain how YouFit collects, uses and shares information from you when you use the Website and to help you make an informed decision as to whether to use or continue using the Website.

WHAT INFORMATION DOES YOUFIT COLLECT FROM ME?

The amount and type of information we gather depends upon your use of the Website and, in some cases, what type of information you choose to disclose. We may collect the following information from you:

PERSONAL INFORMATION PROVIDED BY YOU

We collect information from you when you voluntarily register with YouFit and/or submit your personal information to us over the Website. Such personal information may include your name, email and postal addresses, phone number, gender, age, health and fitness information, product and/or membership plans purchased, any account number assigned to you by YouFit, any customer identification number assigned to you by our payment processor, and other information which you voluntarily provide to us. Our web host, Intelivideo collects personal information from you for payment for on demand content purchased on the Website, and the personal information is transmitted to our third party payment processors by Intelivideo.

This Privacy Policy specifically applies to information collected from you over the Website; however, there are a number of circumstances off the Website and “in real life” where you may provide personal information to us as well, such as:

  • When you enter into a written agreement with YouFit, such as a membership agreement;
  • When you visit one of our clubs, whether as a member or a visitor;
  • When you participate in personal training services;
  • When you execute any agreement or waiver with YouFit as the parent or legal guardian of a minor;
  • When you sign up to receive emails, phone calls, and/or text messages from YouFit regarding your membership and/or promotions and newsletters;
  • When you engage with YouFit through social media;
  • When you execute an authorization for YouFit to automatically charge or debit your membership fees;
  • When you participate in a Corporate Wellness program run by YouFit; and
  • When you enter a contest or promotion run by YouFit.

YouFit makes no effort to segregate information collected on the Website from that provided by you off-Website or in real life. Accordingly, personal information collected on the Website could be combined with information collected through other avenues.

When you use the Website, we and our third party webhost automatically gather information made available by your web browser (such as Microsoft Edge or Google Chrome), Internet service provider (such as Comcast or Cox), and device (such as your computer, phone, or tablet), depending on your settings for each. PAYMENT INFORMATION

All payments initiated through the Website are transmitted to our web host, Intelivideo . Intelivideo sends payments to be processed by third-party vendors, including ABC Financial, Shopify, and Authorize.net, and not YouFit itself. If you make a purchase on the Website, credit card numbers and related information, such as billing address, card number, and the expiration date of the card (“Credit Card Information”) is collected from you, and such information may be sent directly from you to Intelivdeo to our payment processors through embeddable widgets.

HOW DOES YOUFIT USE COOKIES?

“Cookies” are files that are placed on your device by websites you visit. The purpose of a Cookie is to identify you as a unique user of the Website. A web beacon is programming code that can be used to, among other things, transfer an individual’s unique user identification (often in the form of a Cookie) to a database and associate the individual with previously acquired information about an individual in a database. This allows us to track certain websites you visit online. Web beacons are used to determine products or services you may be interested in, and to track online behavioral habits for marketing purposes.

We and our web host currently use Cookie and web beacon technology to associate certain Internet-related information about you with information we already have in our database, for the following purposes:

To Verify You. We use Cookies to verify your account and make it so you do not have to reenter your login information each time you use the Website.

TO COMMUNICATE WITH YOU

We use information gathered on the Website to personalize communication with you, and to respond to your requests for products, services, and information. By providing your email address, telephone number, or mobile number to YouFit through the Website, you consent to receive calls, emails, and texts from YouFit, including information concerning the YOD content, your membership, special offers from YouFit, and advertising and telemarketing messages. Calls and messages may be sent to you through an automatic telephone dialing system or an artificial or prerecorded voice. Providing such consent is NOT a condition of membership or a condition of purchasing any YOD content, goods, or services from YouFit. You can unsubscribe from promotional phone calls and text messages by following the instructions therein. You can unsubscribe to marketing or survey emails at any time by clicking the unsubscribe link within the email. Please note that, even if you unsubscribe from marketing or survey emails, we will still send you any necessary, non-promotional emails about your account or updates to our privacy policy and terms.

TO IMPROVE OUR CLUBS AND SERVICES

YouFit uses the information we collect from you and other users to improve our Clubs and services. For example, we may consider analytics, demographics, and user feedback collected via the Website in determining whether there is sufficient demand for a new Club or additional YOD content.

TO IMPROVE THE WEBSITE

YouFit uses the information we collect from you and other users to provide and improve the Website. As explained above, we use Cookies, including those placed by third parties, to gather statistical information that helps us understand how you and other users engage with the Website and improve its performance.

TO ADVERTISE TO YOU

As explained above, we may use information gathered through Cookies and web beacons, including those placed by third parties, to deliver ads to you once you’ve left the Website.

HOW DOES YOUFIT SHARE MY INFORMATION?

We may share your personally identifiable information with our On Demand web host, Intelivideo, as well as with other third parties that provide us with services for purchasing YOD content. Intelivideo may use your purchase information and billing address to calculate any applicable sales and use tax; however, Intelivideo is not responsible for payment of any applicable taxes and has no liability to you with respect to calculation of taxes or your purchase of our content. We require third parties to protect your information in a manner consistent with this Privacy Policy and to limit their use of your information to the provision of services covered by the Website. We do not sell or otherwise provide your personal information to any other third parties for the purpose of marketing their own products or services. We may share non-personally identifiable information or aggregated data about our users with Intelivideo or other third parties for research, analytical and marketing purposes, such as analyzing usage patterns for certain content, services, advertisements, promotions, and/or functionality on our web site and/or to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. We reserve the right to share your information in order to cooperate with law enforcement proceedings or governmental investigations, such as in response to subpoenas, search warrants, court orders, or other legal processes. You also acknowledge and agree that Intelivideo may disclose your purchase and billing information in order to cooperate with tax authorities’ inquiries, law enforcement proceedings or governmental investigations, such as in response to subpoenas, search warrants, court orders, or other legal processes. We may transfer information about you if we are acquired by or merged with another company, after which this information may become subject to a different policy. If this were to occur, we would notify you via email or post a prominent notice on the Website before transferring this information.

TO FULFILL YOUR ORDERS

We may transfer your information to third parties when necessary to fulfill an order from you. For example, as explained above, your credit card information is provided directly to our payment processor from Intelivideo through the Website so that you can be charged (and we can be paid) for your online purchase.

TO OUR THIRD-PARTY PARTNERS

We may disclose your personal information as needed to our third party web host or service providers and advertising partners. For example, we may share your email address with our email fulfillment provider. The Website may include links to third-party web sites that have independent privacy policies. We have no responsibility for the actions or policies of those third parties or the content of their web sites, their products or their services. Transfer of Information If you are located outside the United States and choose to provide information to us, we may transfer your information to the United States (or any other country where we operate), where the privacy laws may not be as protective as in your country or jurisdiction. TO COMPLY WITH LEGAL PROCESS AND PREVENT HARM

HOW AND WHERE DOES YOUFIT SECURE MY INFORMATION?

YouFit, and the third-party vendors we use to store your information, employ security measures (such as SSL encryption and HTTPS protocol) to protect against the loss, misuse, and alteration of the information under our control. For payment processing, our web host encrypts all of your personal information to transmit it to payment processors. However, no system can be completely secure. Therefore, although we take steps to secure your information, we cannot promise, and you should not expect, that your personal and commercial information, or other communications, will always remain secure.

YouFit stores personal information in the United States. If you are visiting YouFit.intelivideo.com com from a location outside of the United States, your connection will be through and to servers located in the United States, and all information you provide will be processed and securely maintained in our web servers and internal systems located within the United States. By using YouFit.Intelivideo.com you authorize and specifically consent to the transfer of personal information to the United States and its storage and use as specified above when you provide such information to us.

HOW DOES YOUFIT PROTECT THE PRIVACY OF CHILDREN?

The Website requires that a user be 18 years of age to use the Website and YOD content. YouFit will never knowingly collect any personal information about children under the age of 13. If we obtain actual knowledge that we have collected personal information about a child under the age of 13, that information will be immediately deleted from our database. Because we do not collect such information, we have no such information to use or to disclose to third parties. We have designed this policy in order to comply with the Children’s Online Privacy Protection Act (COPPA).

DOES YOUFIT RESPOND TO DO NOT TRACK (DNT) SIGNALS?

DNT is a feature offered by some browsers which, when enabled, sends a signal to websites to request that your browsing is not tracked. YouFit and Intelivideo do not currently respond to DNT requests. The subscriber should email support@intelivideo.com with any related requests.

HOW WILL I FIND OUT ABOUT CHANGES TO THE PRIVACY POLICY?

Each time you use the Website, the then-current version of this Privacy Policy will apply. Although most changes are likely to be minor, we reserve the right to modify this Privacy Policy by posting such modification on this page; however, if changes are significant, we may provide a more prominent notice or email you. Unless we receive your express consent, any revised Privacy Policy will apply only to information collected after the effective date of such revised Privacy Policy, and not to information collected under any earlier version.
